
Q: What operations must register with the
Alabama Department of Environmental
Management (ADEM)?
A: The following operations must register with ADEM:
• All Concentrated Animal Feeding
Operations (CAFOs).
• Animal Feeding Operations (AFOs) designated
as CAFOs by ADEM because of a point source or nonpoint source of pollutants to groundwater of surface waters.
• AFOs that are designated as CAFOs by
ADEM for not meeting or exceeding
Natural Resource Conservation Service
(NRCS) technical standards and guidelines
designed to protect water quality and minimize
offsite odors.
• AFOs that elect to voluntarily register in
order to receive National Pollutant
Discharge Elimination System (NPDES)
permit coverage for construction activities
equal to or in excess of one acre.
• For new or proposed operations and existing
facilities planning an expansion, a
Notice of Registration (NOR) must be submitted
and approved by ADEM at least 30
days before construction and 45 days
before the arrival of animals.
• Existing facilities must re-register their
operations annually with ADEM.
The local Soil and Water Conservation
District office (SWCD) can assist in this
process and will forward the registration to
ADEM. Producers can also communicate and
apply directly to ADEM if desired.
Q: How do I register?
A: • Complete a NOR with the assistance of the local SWCD.
• For facilities that are or will have construction
disturbance equal to or exceeding
one acre, have a Construction Best
Management Practices Plan (CBMPP)
prepared by a QCP approved to design
these plans.

Q: What is an NOR and what information is
required?
A: NOR stands for Notice of Registration
and is the application required for
NPDES permit coverage. Generally
speaking, the NOR asks for information
related to the operator/owner of the facility,
legal structure of the entity, violation
history, locations of land application
sites, soil test information, structure and
animal information, location of the facility,
information related the WMSP and
required QCP annual evaluations, the
facility's proximity to waters and wells,
continuing education, and other relevant
administrative and technical information
required by the NPDES rules.

fees may have to be
charged in the future if
the ADEM AFO/CAFO
program does not
continue to be fully
funded by the Alabama

• For annual re-registrations,
the operator
should contact the
local SWCD to complete
an updated NOR
and have the following
information available: proof of annual QCP
inspection; proof of
five-year PE evaluation
(liquid waste facilities
only); any proposed
modification to
your operation so that
the WMSP can be
updated and modifications
certified; a copy
of the previous year's
land application
records and records of
any litter/manure sold
or given away in the
previous year; current soil test records.
• Develop and implement a comprehensive
Waste Management System Plan (WMSP)
that meets or exceeds NRCS technical
standards and guidelines, prior to place
ment of animals at new or expanding facilities.
• The plan must be prepared and certified by
NRCS or a QCP approved to prepare these
WMSPs. (See last month's magazine for
more information on approved QCP
inspectors for WMSPs)
• Provide proof of a certain number of annual
continuing education (CE) credits.
